PUBLIC NOTICE is hereby given in accordance with Sect. 142 of the Municipal Government Act of the Province of Nova Scotia that the lands and premises situated in the Municipality of the District of Lunenburg hereunder described shall be SOLD BY TENDER.
TERMS: SEALED TENDERS are to be submitted on the Municipality of the District of Lunenburg’s Bid Form in a plain envelope marked “Municipality of The District of Lunenburg Tax Sale Property, Tender #2023-01-002”, addressed to The Treasurer, 10 Allee Champlain Drive, Cookville, NS, B4V 9E4 no later than March 6, 2024, 10:00 a.m.
Tender packages will be available for viewing and download on the Municipal website beginning on Wednesday, January 31st, 2024.
All tenders will be dated, and time stamped when received. In the event two tenders are received for the same amount, bidders will be contacted and given 24 hours to submit a final bid.
The successful bidders will be given three (3) business days after awarding of Tender to pay amount in full or the Tender will be awarded to the next highest bidder(s). The decision of a successful bidder will be final.
Tender Forms and Specifications must be obtained from the Municipal website at www.modl.ca/tax-sales.html. Addendums to the tender package will be issued when the tax sale listing changes and will be only available on the Municipal website. Bidders are responsible for checking the website. Please note that a bid deposit is required for each property equal to the minimum bid in the form of a bank draft or certified cheque. The bid deposit will be applied to purchase price if the bidder is successful; otherwise, it will be returned uncashed. Bid deposits will not be returned if the successful bidder does not follow through with the purchase.
Tenders must be sent by mail or can be dropped off at the above address Monday to Friday between the hours of 8:00 a.m. and 5:00 p.m. It is the responsibility of the bidder to ensure tenders submitted via mail are received by Wednesday March 6th, 2024, at 10:00 a.m. The tender opening is not open to the public.
Please note: faxed and electronic tenders are not acceptable and will not be considered. Any late or noncompliant bids will not be accepted.

Properties may be subject to HST charges, which will be collected from the successful bidder on top of the final bid price. The minimum bid includes certificate of sale fees and tax sale deed fees.

Requirements for Occupancy – Single Unit Dwellings
Minimum Requirements Prior to Occupancy Permit Being Issued (for Single Family Structures)

- All required inspections must be completed.
- Certificate of Installation of On-Site Septic System.
- If applicable, at least one (1) entry door to have landings, steps, handrails, and guards installed to code (National Building Code, 2015 or current edition).
- All interior lofts, stairs, and landings to have handrails and guards installed to code (National Building Code, 2015 or current edition), this also includes basement stairs.
- Air Exchanger to be installed and functioning as well as a Mechanical Ventilation Record to be submitted to this office.
- Plumbing vent to be through roof and of proper size.
- All required smoke alarms/ carbon monoxide alarms to be installed and functioning.
- Shut off valve on all toilets.
- Single key dead bolts installed on all exterior doors.
- Attached garages which have a common wall and/or ceiling shall be gyproced (or other appropriate materials) with joints sealed. Entry door between garage and dwelling shall be made airtight and have a self closing device installed.
- The hot water tank or boiler vessel shall be equipped with the applicable pressure/temperature relief valve. This valve shall be equipped with a pipe to direct exhausted steam within 12 inches of floor level.
- All heating and/or cooling equipment to be installed in accordance with the manufacturer’s instructions or in the absence of instructions, the applicable standard.
- An attic hatch, if applicable, shall be air tight.
- All flue pipe connections shall be secured with a minimum of three sheet metal screws per joint.
- A kitchen sink with hot and cold water, and one (1) toilet and bathtub or shower operational. Also, a door is required on the bathroom with floor covering. NOTE: Trim, kitchen cupboards, or other non essential doors are not required.
- Any additional requirements as may be required by the Building Inspector; please refer to the National Building Code, current edition and its regulations.
- Reflective civic number posted.
- Exterior siding complete.
Please note, these are guidelines only. Depending on the type of construction there may be additional requirements.
Prior to an occupancy permit being issued. The Municipality of the District of Lunenburg does not guarantee this list to be exhaustive or all inclusive. Every construction remains/is subject to the regulations of the current edition of the National Building Code. Please call 902-541-1325 for additional information.

The Freedom of Information and Protection of Privacy (FOIPOP) Act ensures municipalities are fully accountable to the public by providing a right of access to records while preventing the unauthorized collection, use, or disclosure of personal information.
The Municipal Government Act (MGA), provides authority for most of the activities and operations of municipal governments in Nova Scotia. It also contains provisions relating to freedom of information and protection of privacy. These provisions are found in Part XX of the Act.
The intent of Part XX of the MGA is to balance two principles:
- Freedom of information: whenever possible, information held by the municipality should be made available to the public
- Protection of privacy: the municipality should not improperly collect or disclose personal information.
The legislation provides that members of the public have:
- the right to request access to information held by the municipality
- the right to access personal information about themselves that is held by the municipality
- the right to request correction to their personal information that is held by the municipality
- controls on the collection, use, and disclosure of personal information by the municipality
- the right to request independent review of decisions made under the access to information process.

THE MUNICIPALITY OF THE DISTRICT OF LUNENBURG has made application to the Board under section 369 of the Municipal Government Act to confirm the number of councillors to be elected and to alter the boundaries of the polling districts. This matter will be considered in a public hearing as follows:
